Mascot Consultants provides professional architectural design, construction consultancy, map creation, surveying, and related services in Pakistan, with a focus on Khyber Pakhtunkhwa. Our services include but are not limited to:

• Construction supervision and management
• Land surveying and map creation
• MEP (Mechanical, Electrical, Plumbing) design
• Project management and consultancy
• Building inspection and quality control

2. Use of Services

Eligibility

You must be at least 18 years old and have the legal capacity to enter into contracts to use our services. By using our services, you represent and warrant that you meet these requirements.

Acceptable Use

You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Transmit any harmful or malicious code
• Attempt to gain unauthorized access to our systems
• Use our services for any fraudulent or illegal purpose
• Interfere with the proper functioning of our website or services

3. Client Responsibilities

When engaging our services, clients are responsible for:

• Providing accurate and complete project information
• Obtaining necessary permits and approvals
• Ensuring site access for surveys and inspections
• Making timely payments as per agreed terms
• Reviewing and approving designs and plans in a timely manner
• Complying with all applicable building codes and regulations

4. Project Agreements and Contracts

All project engagements will be governed by a separate written agreement that specifies:

• Scope of work and deliverables
• Project timeline and milestones
• Fees and payment terms
• Responsibilities of both parties
• Intellectual property rights
• Confidentiality provisions
• Dispute resolution procedures

5. Fees and Payment

Service fees will be determined based on project scope and complexity. Payment terms will be specified in the project agreement. Generally:

• An initial deposit may be required to commence work
• Progress payments will be tied to project milestones
• Final payment is due upon project completion
• Late payments may incur additional charges
• All fees are exclusive of applicable taxes

6. Intellectual Property Rights

All designs, drawings, plans, specifications, and other work products created by Mascot Consultants remain our intellectual property until full payment is received. Upon full payment, clients receive a license to use the work products for the specific project. We retain the right to use project images and information for marketing purposes unless otherwise agreed.

7. Warranties and Disclaimers

We warrant that our services will be performed with reasonable skill and care in accordance with professional standards. However:

• We do not guarantee specific project outcomes or results
• We are not responsible for delays caused by factors beyond our control
• We do not warrant that our services will be uninterrupted or error-free
• Clients are responsible for verifying compliance with all applicable regulations

8. Limitation of Liability

To the maximum extent permitted by law, Mascot Consultants shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, revenue, or business opportunities
• Damages exceeding the fees paid for the specific project
• Damages resulting from client's failure to follow recommendations
• Third-party claims or actions

9. Confidentiality

We respect the confidentiality of client information and will not disclose confidential information to third parties without consent, except as required by law or necessary to perform our services. Both parties agree to maintain confidentiality of sensitive project information.

10. Termination

Either party may terminate a project agreement with written notice. Upon termination:

• Client must pay for all services rendered up to the termination date
• We will deliver all completed work products
• Both parties will return confidential information
• Provisions regarding intellectual property and confidentiality survive termination

11. Dispute Resolution

In the event of any dispute arising from these Terms or our services:

• Parties agree to first attempt resolution through good faith negotiations
• If negotiations fail, disputes may be submitted to mediation
• Any legal proceedings shall be governed by the laws of Pakistan
• Jurisdiction shall be in the courts of Peshawar, Khyber Pakhtunkhwa

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
