These Terms of Service (“Terms”) govern your use of the Mascot Consultants website and your engagement of our consultancy services in architecture, engineering, surveying, map creation, building planning, and project management.

The specific scope, deliverables, milestones, and fees are outlined in our written proposals or agreements.

3. Proposals, Engagements, and Changes

Proposals remain valid for the period stated.

Engagement begins upon written acceptance or signing, and may require an advance payment.

Variations to scope must be agreed in writing.

Additional work will be billed at agreed rates or through a formal change order.

4. Client Responsibilities

Provide accurate and timely project information, approvals, and decisions

Ensure site access and compliance with applicable laws and regulations

Obtain necessary third-party consents where required

5. Fees, Invoices, and Payment

Fees are as stated in the proposal/contract. Taxes (if applicable) are additional.

Invoices are due within the payment terms specified. Late payments may result in interest charges or suspension of services.

Expenses (e.g., travel, plotting/printing, permits) may be billed at cost unless otherwise agreed.

6. Schedules and Delays

Schedules are estimates and depend on timely client inputs, approvals, and external dependencies (e.g., authorities, suppliers).
We are not liable for delays caused by factors beyond our reasonable control.

7. Intellectual Property

Unless agreed otherwise, all drawings, models, designs, reports, and documents are our intellectual property.

Upon full payment, you receive a non-exclusive, non-transferable license to use deliverables for the specified project and location only.

We may reference non-confidential project information and visuals in our portfolio and marketing unless you object in writing.

8. Confidentiality

Each party will keep confidential information private and use it only for the project, except where disclosure is required by law or permitted in writing.

9. Third-Party Services and Links

Our website may contain links to third-party sites.
We are not responsible for their content, policies, or practices.

10. Warranties and Disclaimers

Services are provided with reasonable skill and care.
Except as expressly stated in writing, we disclaim all warranties, including:
Fitness for a particular purpose
Non-infringement
Website content is provided “as is” and for general information only.

11. Limitation of Liability

To the maximum extent permitted by law, Mascot Consultants shall not be liable for any indirect, incidental, special, consequential, or exemplary damages.
Our total liability relating to the services is limited to the total fees paid to us for the specific engagement giving rise to the claim.

12. Indemnity

You agree to indemnify and hold Mascot Consultants harmless from claims arising from:
Your breach of these Terms
Misuse of the deliverables
Except where caused by our willful misconduct or gross negligence.

13. Termination

Either party may terminate the agreement for material breach if not cured within a reasonable notice period.

Upon termination, fees for work performed and committed costs become due.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Pakistan.
Courts located in Peshawar, Khyber Pakhtunkhwa have exclusive jurisdiction, without regard to conflict-of-law principles.
